A Swedish ISP has deleted all retained customer data after European Union laws that require communications providers to retain metadata were invalidated by the EU’s supreme court earlier this week. The ISP on Thursday called on other providers to do the same.
Under EU rules, telecommunications and Internet providers are required to retain data necessary to identify the subscriber, as well as traffic and location data, in order to help investigations of serious crimes and terrorism. However, the EU’s Data Retention Directive was invalidated on Tuesday by the Court of Justice of the EU (CJEU), which ruled that the directive seriously interferes with fundamental privacy rights.

Massive companies like AT&T and Comcast have spent the first two months of 2014 boldly announcing plans to close and control the internet through additional fees, pay-to-play schemes, and sheer brutal size — all while the legal rules designed to protect against these kinds of abuses were struck down in court for basically making too much sense. “Broadband providers represent a threat to internet openness,” concluded Judge David Tatel in Verizon’s case against the FCC’s Open Internet order, adding that the FCC had provided ample evidence of internet companies abusing their market power and had made “a rational connection between the facts found and the choices made.” Verizon argued strenuously, but had offered the court “no persuasive reason to question that judgement.”

'It appears that the method they were using was to poison the A record of retailers and do a 301 redirect back to the www cname. This is due to the way apex, or 'naked' domain names work.' Upon contacting the ISP, they offered him access to two DNS servers that don't perform the injection, but they showed no indication that they would stop, or opt-out any other subscribers. (It was also the only wireless provider in his area, so he couldn't just switch to a competitor.) Helgeson then sent the data he gathered to the affiliate programs of major retailers on the assumption that they'd be upset by this as well. He was right, and they put a stop to it. He says, 'ISP's ask you to not do crummy things on their networks, so how about they don't do the same to their customers?'"
